Modo 2 - Tone control in passive mode does not work

When using bass models with active pickups, e.g. Metal Bass, it no longer seems possible to convert them to passive pickups and use the passive tone control.
Do others notice this?

Actually, Japan Bass is listed as passive, but, the tone control does nothing in passive mode.
Please can it be reverted to that function in Modo Bass 1?

Something else; I'm finding on some basses, I'm getting sticking notes, as though the sustain off pedal for some notes does not work.
